1. General Provisions
This Personal Data Processing Policy is drafted in accordance with the requirements of Federal Law No. 152-FZ of July 27, 2006, "On Personal Data," and defines the procedure for processing personal data and the measures to ensure the security of personal data taken by TREND-SOFT LLC (hereinafter referred to as the "Operator").
1.1. The Operators highest priority and condition for conducting its activities is the observance of human and civil rights and freedoms when processing their personal data, including the protection of the rights to privacy, personal, and family secrets.
1.2. This Operators Policy regarding the processing of personal data (hereinafter referred to as the "Policy") applies to all personal data processed by the Operator, as specified in Section 3 of this Policy.
2. Key Terms Used in the Policy
2.1. Automated Processing of Personal Data — processing of personal data using computer technology;
2.2. Blocking of Personal Data — temporary suspension of personal data processing (except when processing is necessary to clarify personal data);
2.3. Website — a collection of graphical and informational materials, as well as computer programs and databases, ensuring their availability on the internet at the domain https://filmtoolz.ru/, including all subdomains;
2.4. Personal Data Information System — a set of personal data contained in databases and the information technologies and technical means enabling their processing;
2.5. Depersonalization of Personal Data — actions rendering it impossible to determine the ownership of personal data by a specific User or other subject of personal data without additional information;
2.6. Processing of Personal Data — any action (operation) or set of actions (operations) performed with personal data, with or without automation, including collection, recording, systematization, accumulation, storage, clarification (updating, modification), retrieval, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, or destruction of personal data;
2.7. Operator — a state body, municipal authority, legal entity, or individual independently or jointly organizing and/or processing personal data, as well as determining the purposes of processing, the composition of personal data to be processed, and the actions (operations) performed with personal data;
2.8. Personal Data — any information directly or indirectly related to an identified or identifiable User of the website https://www.filmtoolz.ru/;
2.9. User — any visitor to the website https://www.filmtoolz.ru/;
2.10. Provision of Personal Data — actions aimed at disclosing personal data to a specific person or group of persons;
2.11. Dissemination of Personal Data — actions aimed at disclosing personal data to an indefinite circle of persons (transfer of personal data) or making personal data available to an unlimited number of persons, including publication in mass media or placement in information and telecommunication networks;
2.12. Cross-Border Transfer of Personal Data — transfer of personal data to the territory of a foreign state, a foreign authority, or a foreign individual or legal entity;
2.13. Destruction of Personal Data — actions resulting in the irreversible destruction of personal data, making it impossible to restore the content of personal data in the information system or destroying the physical media containing personal data.
3. Legal Basis for Processing Personal Data
3.1. The legal grounds for processing personal data include:
a) Consent to the processing of personal data, expressed in a manner prescribed by law and this Policy;
b) Agreements concluded between the Operator and the User;
c) The Operators charter;
d) The Operators internal policies.
3.2. The personal data subject freely, voluntarily, and in their own interest decides to provide their personal data and consents to their processing. Inaction by the personal data subject shall not be construed as consent. Consent must be specific, informed, conscious, and unambiguous. Consent to this Policy may be expressed by the personal data subject through the following actions:
a) During registration, the User checks a box (or clicks a button) next to text such as: "I accept the Terms of Service," "I accept the Privacy and Personal Data Processing Policy."
By checking the box, the User:
a) Confirms that all data provided during registration is accurate and belongs to them personally;
b) Acknowledges that they have read this Agreement and the terms of personal data processing in full and agrees to them;
c) Consents to the processing of their personal data for the purposes of concluding and executing this Agreement;
d) Expresses unconditional agreement with the terms of personal data processing;
e) Under Federal Law No. 152-FZ of July 27, 2006, "On Personal Data," freely consents to the collection, analysis, processing, storage, and use of their personal data (e.g., name, phone number, email).
The Users consent is specific, informed, and conscious. This consent is considered given in simple written form. The User grants the Operator the right to perform the following actions with their personal data:
a) Collection and accumulation;
b) Storage for the period required by law (at least three years from the date of termination of service use);
c) Clarification (updating, modification);
d) Use;
e) Destruction;
f) Depersonalization;
g) Transfer to third parties (e.g., courts) where required by law, with safeguards against unauthorized access.
This consent is indefinite and may be revoked by the User via written request to the Operator, as per Article 14 of Federal Law No. 152-FZ of July 27, 2006. Revocation may be sent to info@filmtoolz.ru.
The Operator is not liable for third-party use (lawful or unlawful) of information published by the User on the Website. The Operator reserves the right to amend this Agreement at any time. The current version is available at https://account.filmtoolz.ru/privacy/.
4. Purposes of Processing User Personal Data
4.1. Purpose: Registration and authentication of the User, providing access to services and materials on the Website.
Data Processed: Name, phone number, email.
Processing Methods: Collection, recording, storage, updating, deletion, etc.
Storage Period: Until the User requests termination of processing or account deletion.
4.2. Purpose: Registration of legal entity representatives.
Additional Data: Workplace or represented legal entity name.
4.3. Purpose: Communication with the User (notifications, responses, promotional messages).
Opt-Out: Users may unsubscribe by emailing info@filmtoolz.ru with "Unsubscribe" in the subject.
4.4. Purpose: Analytics to improve Website functionality.
Tools Used: Includes Yandex.Metrika (see its confidentiality policy).
4.5. Purpose: Casting database (Casting.Filmtoolz.ru) for actors/agents.
Data Published: Height, weight, education, nationality, photos, videos, etc.
4.5.1–4.5.5. Cookie Policy:
- Types: Technical (essential), preference (e.g., language), analytical (statistics).
- Third-party cookies (e.g., Yandex.Metrika) are governed by their policies.
- Consent is obtained via pop-up: "This site uses cookies for optimal performance."
5. Personal Data Protection Measures
5.1. The Operator implements safeguards against unauthorized destruction, loss, alteration, or disclosure of personal data.
5.2. Access is restricted to personnel requiring data for stated purposes, subject to confidentiality obligations.
5.3. Physical and digital security of processing locations is ensured.
5.4. Disclosure to third parties (e.g., law enforcement) occurs only as required by Russian law.
5.5. The Operator assumes Users provide accurate information per the principle of good faith (Civil Code Art. 19).
6. Transfer of Personal Data to Third Parties
6.1. Data may be shared with:
a) Legal successors (e.g., business sale);
b) Authorities as required by law;
c) Parties defending the Operator’s legal rights;
d) Third parties with User consent (e.g., casting database publication).
6.2. Users may manage data sharing via Website settings or by emailing the Operator.
7. Storage Rules and Cross-Border Transfer
7.1. Data of Russian citizens is processed within Russia.
7.2. Cross-border transfer is not performed.
